EPA TSCA §8(a)(7) PFAS Reporting Guide
Who must report under EPA's TSCA §8(a)(7) PFAS rule, what the one-time and annual deadlines are, and what data you need to assemble — a starting point, not legal advice.
EPA TSCA §8(a)(7) PFAS Reporting
Under the federal Toxic Substances Control Act, EPA's TSCA §8(a)(7) rule (40 CFR Part 705) requires manufacturers and importers of PFAS to report detailed information on their PFAS activities to EPA through the Chemical Data Reporting (CDX) system.
What the deadline is
The rule requires a one-time report covering the period from 2011 through 2022; that report was due July 11, 2025 (after EPA extended the original 2025 deadline). For PFAS first manufactured or imported in 2023 or later, reports are due annually.
EPA has proposed revisions to the rule. Under TSCA, any revised deadline is set relative to the effective date of the final revised rule, so the exact future dates depend on when a revision becomes effective. Check EPA's PFAS reporting page for the current deadline before you file.
Who must report
You must report if, in any year since 2011, you:
- Manufactured (or imported) a PFAS for commercial purposes, or
- Manufactured a PFAS as a byproduct or impurity that meets the rule's threshold
Small manufacturers are generally exempt from the historical (2011-2022) reporting, but are not exempt from reporting PFAS manufactured in 2023 or later. Importers of articles containing PFAS are included in some cases.
What evidence is required
EPA asks for, among other things:
- Chemical identity (name, CAS number, structural formula)
- Uses and downstream applications
- Production volume (amount manufactured) and import volume
- Byproducts and impurities
- Worker exposure information
- Environmental and disposal release information
To prepare, collect supplier declarations and SDS that identify PFAS chemistry and function across your bill of materials. PFAS Compliance Desk helps you gather that supplier evidence and export a structured record — it does not submit to EPA for you.
